Important. This website provides general education, not medical advice. Using it does not make you a patient of OPTIMIZE MD. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
1. Agreement to these terms
These Terms of Service (the “Terms”) are an agreement between you and [TO CONFIRM: legal entity name], which does business as OPTIMIZE MD by Ask Health (“OPTIMIZE MD,” “we,” “us,” or “our”). They govern your use of this website and any request you submit through it. By using the website, you agree to these Terms. If you do not agree, please do not use the website.
Our Privacy Policy and SMS Terms are part of these Terms. Clinical care you receive as a patient is also governed by the consent forms, financial policies, and Notice of Privacy Practices you receive at your first visit.
2. Educational content only, not medical advice
The content on this website, including the body map, guides, program descriptions, and journal articles, is for general educational purposes. It is not medical advice, diagnosis, or treatment, and it is not a substitute for an evaluation by a qualified physician. Do not start, stop, or change any medication or treatment based on this website.
Regulatory status is described for education. Where the website labels a therapy as FDA-approved, physician-compounded, or investigational, that label is a general description at the time of writing. Regulatory status can change, and the inclusion of a therapy on the website does not mean it is available, appropriate, or legal for any particular person.
3. No physician–patient relationship through the website
Using this website, submitting the contact form, subscribing to the newsletter, or exchanging scheduling messages does not create a physician–patient relationship. That relationship begins only when an OPTIMIZE MD physician evaluates you and agrees to provide care.
4. Clinical eligibility
Clinical eligibility determines all treatments. Every therapy, device treatment, medication, and peptide described on the website is offered only when an OPTIMIZE MD physician determines, after evaluation, that it is medically appropriate for you. We may decline to provide any treatment. Results vary from person to person, and we do not guarantee any particular outcome.
5. Programs, pricing, and payment
- OPTIMIZE MD programs (Foundation, Plus, and Complete) are cash-pay services. Pricing is shared at consultation and confirmed in writing before you enroll.
- Medications, laboratory testing, and device treatments are subject to clinical eligibility and may be billed separately.
- OPTIMIZE MD does not bill insurance directly for program fees. [TO CONFIRM: HSA/FSA acceptance and whether documentation for insurance reimbursement is provided]
- Cancellation, rescheduling, and refund terms are provided in writing when you enroll. [TO CONFIRM: cancellation and refund policy]
6. Your use of the website
You agree to use the website lawfully and not to:
- Submit false information or information about another person without their permission.
- Submit detailed medical history, which should be shared only during your visit.
- Attempt to interfere with, overload, or gain unauthorized access to the website or its systems.
- Copy, scrape, or republish website content except as allowed in Section 7.
You must be at least 18 years old to submit a request through the website.
7. Intellectual property
The website and its content, including text, graphics, the body map, logos, and the OPTIMIZE MD name and marks, are owned by OPTIMIZE MD or its licensors and are protected by law. You may view and share pages for personal, non-commercial use with attribution. Any other use requires our written permission.
8. Third-party links and services
The website may link to third-party websites or use third-party services, such as scheduling and messaging tools. We are not responsible for third-party content or practices, and their own terms apply.
9. Disclaimers
The website is provided “as is” and “as available.” To the fullest extent permitted by law, OPTIMIZE MD disclaims all warranties regarding the website, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the fullest extent permitted by law, OPTIMIZE MD and its physicians, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or reliance on its content. Our total liability for any claim arising from your use of the website will not exceed one hundred U.S. dollars (US$100). This section does not limit liability for medical care, which is governed by applicable law, or any liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless OPTIMIZE MD from claims arising out of your misuse of the website or your violation of these Terms, to the extent permitted by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. Any dispute arising from these Terms or the website will be brought in the state or federal courts located in [TO CONFIRM: county], Michigan, and you consent to jurisdiction there.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continuing to use the website after an update means you accept the updated Terms.
14. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the documents referenced in Section 1, are the entire agreement between you and OPTIMIZE MD about the website.
